HKSAR passport application

Generally speaking, a person is eligible to apply for a HKSAR passport
if he/she is a CHINESE CITIZEN holding a Hong Kong Permanent Identity Card
(PIC) of the Region and has the Right of Abode (ROA) in the HKSAR.

Under the present arrangement, eligible applicants for HKSAR passport
residing overseas may submit their HKSAR passport applications by post
or in person to their nearest Chinese Embassy / consulate-general. [For
persons at or above the age of 16, forms ID844 is appropriate.]

For the addresses and telephone numbers of the Chinese diplomatic and
consular missions, you may visit the website:

Application forms cannot be downloaded from the internet, however forms
are obtainable from Chinese diplomatic and
consular missions or the HKSAR Immigration Department.
Alternatively, should you wish to obtain the application form, you may provide us
your postal address.

The applications will then be forwarded to the HKSAR Immigration
Department for processing and the prepared passports will be sent back
to the Chinese embassy / consulate-general for issue.
As an alternative, the applicants may submit the completed application
forms and the passport fee (in cashier order or bank draft) with
photocopies of the supporting documents directly by post to the HKSAR
Immigration Department < Travel Documents and Nationality (Application)
Section, Immigration Tower, 7 Gloucester Road, Wanchai, Hong Kong.>
However, they are required to collect the
prepared passports IN PERSON at the HKSAR
Immigration Department with the originals of the supporting documents.

For those applicants residing overseas, if they are eligible but have
NOT registered a Hong Kong PIC before, they will have to apply for PICs
at the same time as they apply for HKSAR passports. If this is the case,
the applicants should submit completed application forms for Hong Kong
permanent identity card (ROP144 for persons under the age of 11)
together with the passport applications. The Hong Kong PICs will be
issued together with the HKSAR passports.
Applicants who have already been issued Hong Kong PICs before are not
required to submit the form ROP144 again.
Such PICs issued overseas will be valid as long as the holders remain
abroad but should be renewed within 30 days after their return to the
HKSAR unless the holders are under the age of 11.

Regarding the processing time, under normal circumstances, if the
applicants already have Hong Kong PICs, the processing time will be
about 4-6 weeks. It will take about 8 weeks if the applicants has no
Hong Kong PIC. It may take a LONG processing time if the applicants'
Chinese citizenship and eligibility for PIC cannot be verified right
away. The time for forwarding the
applications and despatching the prepared passports is excluded.

As mentioned in your last e-mail and your intention to apply for a
HKSAR passport, you may directly apply for a HKSAR passport
for your child if he/she is eligible for that :-
a person is eligible to apply for a HKSAR passport if he/she is a
Chinese Citizen holding a HK permanent identity card. (for child
who is under 11 years of age and does not hold the permanent ID,
he/she will be issued with one in conneciton with the HKSAR
passport application).

Subject to the approval of the HKSAR passport and the issue
of the HKpermanent ID, the holder's right of abode in HKSAR
and Chinese citizenship have been established and there is no need
to apply for certificate of entitlement to prove one's right of abode
and permanent residency in HKSAR.

For documents to be submitted to support the application, please
refer to the website as quoted in my last e-mail.
Regarding the birth certificate, you may submit your child UK issued
birth certificate as he/she was born in UK.

For right of abode in HKSAR,
according to paragraph 2(a) to (f) of Schedule 1 to the Immigration
Ordinance which has come into operation on 1
July 1997, a person who is within one of the following categories is a
permanent resident of the HKSAR:-
(a) A Chinese citizen born in Hong Kong before or after the
establishment of the HKSAR.
(b) A Chinese citizen who has ordinarily resided in Hong Kong for a
continuous period of not
less than 7 years before or after the establishment of the HKSAR.
(c) A person of Chinese nationality born outside Hong Kong before or
after the establishment of
the HKSAR to a parent who, at the time of birth of that person, was a
Chinese citizen falling
within category (a) or (b).
(d) A person not of Chinese nationality who has entered Hong Kong with
a valid travel document,
has ordinarily resided in Hong Kong for a continuous period of not less
than 7 years and has
taken Hong Kong as his place of permanent residence before or after the
establishment of the
HKSAR.
(e) A person under 21 years of age born in Hong Kong to a parent who
is
a permanent resident of
the HKSAR in category (d) before or after the establishment of the
HKSAR
if at the time of his
birth or at any later time before he attains 21 years of age, one of
his
parents has the ROA in
Hong Kong
(f) A person other than those residents in categories (a) to (e), who,
before the establishment of the
HKSAR, had the ROA in Hong Kong only.

Chinese Nationality :-

In brief, Chinese citizens include Hong Kong residents and former
residents who are of Chinese descent and born in
Chinese territory (including Hong Kong), notwithstanding that they
hold,
or have held Hong Kong British Dependent
Territories Citizen passports, British National (Overseas) passports or
any foreign passports.

If an overseas born child has acquired foreign nationality at birth and
that his/her parents "have settled" in foreign
country, he/she "WILL NOT HAVE Chinese nationality" in accordance with
the Article 5 of the Nationality Law of the People's Republic of China
(CNL) which stipulates :-
"Any person born abroad whose parents are
both Chinese nationals or one of whose parents
is a Chinese national shall have Chinese
nationality. But a person whose parents are
both Chinese nationals and have both settled
abroad, or one of whose parents is a Chinese
national and has settled abroad, and who has
acquired foreign nationality at birth shall not
have Chinese nationality."

If your child was born overseas and born after 1 July 1997, whether or
not he may acquire the ROA in the HKSAR
depends on if he is a Chinese citizen and fulfils the requirements
at paragraph 2(c) of Schedule 1 to the Immigration Ordinance as
mentioned above. If he is a Chinese citizen and fulfils the
requirements at paragraph 2(c) of Schedule 1 to the Immigration
Ordinance, he may submit an application under the topics "Application
for Verification of Eligibility for Permanent Identity Card" (ROP145)
OR
"Application for Certificate of Entitlement" as mentioned below
initially. If however, your children have acquired foreign nationality
at
birth and that his parents "have settled" in foreign country, he
"WILL NOT HAVE Chinese nationality" in accordance with the Article 5 of
CNL and he could not acquire ROA immediately.

thanks for your info. i won't get a hksar passport for valerie (she is not eligible for it) and i think a us passport is good enuf. all i want is to get her a hkid card so she will have more choices as to where to live and work...as both me and my husband's families are in hk and we have a lot of attachments there.

Same as me, I don't mind if Amanda can not get the HKSAR passport, but I really wish if she can get the HK ID card... I will try again at end of this end when we go back to hk for my father's 60th birthday!
